La Aeronáutica Civil aprobó la integración empresarial de Viva Air y Avianca, modificado algunas de las condiciones que había expedido en la resolución del pasado 21 de marzo, luego de resolver los recursos de apelación en segunda instancia de las integradas y de Wingo, Ultra, Latam, JetSamrt y la Procuraduría General.
La autoridad determinó al menos cuatro condiciones para darle ‘luz verde’ a la operación que se estudia desde hace ocho meses. Ratificó la condición que busca atender los derechos de los usuarios afectados tras la cancelación de las operaciones de Viva Air el pasado 27 de febrero. “Que se les reembolsen los tiquetes de los vuelos cancelados o se les permita volar a quienes tengan reservas y tiquetes pendientes de ejecutar”, indica
Una de las modifiaciones está relacionada con los slots del Aeropuerto El Dorado de Bogotá, la mayor discusión en este trámite. La Aerocivil precisó que la devolución de las franjas horarias de salida y llegada se ajustarán de tal manera que permita la utilización más eficiente de la infraestructura del aeropuerto y, al tiempo, garantice las condiciones de competencia y posibilite la permanencia de Viva Air.
Además, el ente integrado deberá comprometerse en mantener el esquema de bajo costo de Viva Air, especialmente, en aquellas rutas que solo eran operadas por esta aerolínea. También exige la nueva resolución que se devuelvan las frecuencias en la ruta Bogotá-Buenos Aires, en caso de ser requerido, “la cual resulta particularmente impactada por la transacción, velando por los derechos de los pasajeros y sin afectar la oferta de sillas, abriendo la posibilidad a otros operadores, cuando haya manifestaciones de interés“.
A partir de la fecha de expedición de la nueva resolución, 5 de mayo de 2023, Viva y Avianca tendrán cinco días calendario para comunicarle al país, a los usuarios y a la autoridad aeronáutica su decisión final de implementar o no la integración.
