“El Invima respeta y acata las providencias judiciales. El Instituto trabaja en la formulación del plan de respuesta urgente a la situación de desabastecimiento de medicamentos”, afirmó el Invima sobre el anuncio del Consejo de Estado.
El llamado lo reiteró el Consejo de Estado, el cual aceptó una tutela en contra de la subsección A de la sección Primera del Tribunal en el cual alegó para que se “amparen sus derechos fundamentales al debido proceso y a la igualdad que estima vulnerados en el trámite”.
Sin embargo, el Consejo de Estado ratificó que se deberá enfrentar la escasez de medicamentos en el país.
“Desde luego que las anteriores aseveraciones no constituyen prejuzgamiento, es decir, que no comprometen ni determinan la decisión que ponga fin a esta controversia, porque se realizan con criterio estrictamente preliminar”, informó el Consejo de Estado.
Decisión del Tribunal de Cundinamarca
El pasado 31 de octubre el Tribunal de Cundinamarca emitió medida cautelar de urgencia para que se adopte un plan inmediato que permita atender y darle solución a la falta de medicamentos en el territorio nacional.
El plan deberá establecer soluciones a la escasez de medicamentos, principalmente garantizando la disponibilidad de los fármacos prioritarios y de los activos que tienen amplia insuficiencia.
“Priorizar el trámite y resolución de las 27.904 solicitudes de registro de medicamentos que cursan ante el Invima, que se encuentran pendientes, a fin de garantizar la disponibilidad en los canales institucionales y comerciales. Definir las estrategias para facilitar el acceso a la materia prima requerida para la fabricación de medicamentos“, informó el Tribunal.
