La nueva retención o impuesto que se aplicará desde el primero de enero de 2024 será del 10 % para los pagos por la venta de bienes y servicios realizados por empresas extranjeras que operan en Colombia.
La norma que regula los tributos de personas no residentes es la Ley 2277 de 2022, que introdujo dos artículos 20-3, 20-4. También, se reglamenta mediante el artículo 408 del Estatuto tributario.
Entonces, a los que se les aplicará la retención son a las empresas no residentes del país que tienen una fuerte presencia en Colombia y que obtienen importantes sumas de dinero de clientes del país, como por ejemplo, Spotify, Netflix, Amazon, entre otras.
Ahora bien, si una empresa quisiera evitar ese 10 %, la opción que tiene es presentar la declaración al Gobierno y liquidar el 3 %.
Sin embargo, según Diego Guevara, especialista en Impuestos y líder de investigación tributaria de Actualícese, también deberían pagar las entidades emisoras de tarjetas de crédito, vendedores de tarjetas prepago y otros actores.
Y con respecto a las empresas, según Guevara, no todas entran, sino únicamente las que tengan ingresos brutos superiores a 31.300 Unidades de Valor Tributario UVT por transacciones.
