Admiten demanda contra elección de fiscal general, Luz Adriana Camargo

El Consejo de Estado admitió estudiar una demanda contra la elección de Luz Adriana Camargo como fiscal general de la Nación. La demanda fue presentada por presuntos vicios que se habrían registrado en el proceso de votación y selección que adelantó la Corte Suprema de Justicia.

El documento señala que la demanda de nulidad electoral, instaurada por el ciudadano Samuel Alejandro Ortiz, que busca obtener la nulidad de los actos de elección de Luz Adriana Camargo como fiscal general de la Nación, reúne los requisitos establecidos para avanzar con el proceso.

En la demanda presentada por Samuel Ortiz se aseguró que Camargo no podría ocupar el cargo de fiscal general, pues el 12 de marzo, cuando fue seleccionada por el alto tribunal al contar con 18 votos, otra ternada, Amelia Pérez, había presentado su renuncia y por esto el presidente Gustavo Petro debía designar una nueva candidata y retomar las votaciones.

“La renuncia de Pérez obligaba a suspender la elección de fiscal en la Corte y lo que debía proceder era que le solicitaran al presidente de la república que recomponga la terna”, se lee en la demanda.

Ortiz Mancipe también afirmó en el documento que se llevó a cabo un proceso de selección inapropiado, lo que llevó a señalar a la Sala Plena por una posible desviación de poder al aplicar supuestos sesgos y prejuicios contra las candidatas Ángela María Buitrago y Amelia Pérez Parra.

La Sección Quinta, al determinar que la demanda reúne todos los requisitos, notificó a la fiscal general. También se notificó a la Corte Suprema de Justicia y a la Presidencia de la República para que respondan a la demanda y proporcionen los antecedentes administrativos del acto de elección.
